Terms of Service

These Terms of Service (the "Terms") set out the conditions for using ReefBook (the "Service"), a coral encyclopedia, husbandry-log, and collection-management service provided by M-Assets Corporation (the "Company"). By using the Service, users agree to these Terms.

Article 1 (Scope and Definitions)

These Terms apply to all relationships between the Company and users regarding use of the Service. In these Terms, "Service" means ReefBook; "Company" means M-Assets Corporation; "User" means anyone who uses the Service; "Member" means a user who has registered an account; and "User Content" means the records of living specimens, photographs, provenance (named-lineage) information, and any other information that users register or post on the Service.

Article 2 (Account Registration and Management)

Some Member features of the Service are currently in preparation. Where a user registers as a Member, the user manages their account at their own responsibility and shall comply with the following.

  • Keep registration information accurate and up to date
  • Not disclose or lend login credentials (such as passwords) to any third party
  • Promptly notify the Company upon discovering any unauthorized use of the account

Article 3 (Handling of User Content)

Content posted by users to the Service is handled as follows.

  • Users represent and warrant that they hold the necessary rights to their User Content, or have obtained permission from the rights holder.
  • Copyright and other rights in User Content remain with the user. The user grants the Company a royalty-free license to use the User Content (including reproduction, display, translation, and technical processing) to the extent necessary to provide, maintain, and improve the Service.
  • The visibility of each item of User Content (private, unlisted, or public) is chosen by the user, and this setting is configured at the user's own responsibility.
  • The Service may use AI to present candidate entries or drafts, but their accuracy is not guaranteed. Users are responsible for reviewing the content themselves before publishing or finalizing it.

Article 4 (Prohibited Activities)

In using the Service, users shall not engage in any of the following acts.

  • Acts that violate laws, regulations, or public order and morals
  • Registering or posting false information (including false claims about a specimen's provenance or lineage)
  • Infringing the copyright, portrait rights, privacy, or other rights of third parties (including unauthorized reposting of others' photographs)
  • Acts that cause disadvantage, damage, or discomfort to other users or third parties
  • Interfering with the operation of the Service, or placing an excessive load on its servers or networks
  • Unauthorized access, improper acquisition of accounts, or other acts that compromise security
  • Any other act the Company reasonably deems inappropriate

Article 5 (Nature of Encyclopedia and Lineage Information)

The encyclopedia and named-lineage information provided by the Service, together with users' provenance records, are offered as reference information only and do not constitute academic or taxonomic determinations.

  • A specimen's lineage is not established from photographic appearance alone.
  • A specimen's provenance is treated as a user's "claim" together with its verification status (unverified, under verification, verified, etc.).
  • Information about regulated species is general reference only. When handling such species, please confirm the latest applicable laws on your own responsibility.

Article 6 (Disclaimers)

The Company's responsibility regarding use of the Service is as follows.

  • The Company does not warrant the accuracy, completeness, or usefulness of information provided through the Service.
  • The Company is not responsible for the results of keeping or managing living organisms. Husbandry decisions are made at the user's own responsibility.
  • Where the Service provides links to external sites (including the Company's affiliated sister sites), the Company is not responsible for the content of, or the terms and policies of, those linked sites.
  • Except in cases of the Company's intent or gross negligence, the Company is not liable for damages incurred by users through use of the Service.

Article 7 (Change, Suspension, and Termination of the Service)

The Company may change the content of the Service, or suspend or terminate its provision, without prior notice to users. The Company bears responsibility for any resulting damage to users within the scope of the preceding article.

Article 8 (Changes to these Terms)

The Company may amend these Terms when it deems necessary. The amended Terms take effect from the time they are posted on the Service. For significant changes, the Company will notify users by appropriate means.

Article 9 (Governing Law and Jurisdiction)

These Terms and the use of the Service are governed by the laws of Japan. In the event of a dispute between the Company and a user regarding the Service, the Sendai District Court, which has jurisdiction over the location of the Company, shall be the court of exclusive agreed jurisdiction for the first instance.
